The influence of fundamental rights on the Ecuadorian notarial services and relations between individuals

The Constitutional Court of Ecuador analyzed Ruling No. 832-20-JP/21, which, through its powers of selection and review, considered that the case of an elderly woman in a vulnerable situation who had lost the only real estate in which she could live through sale and purchase met the gravity criteria for issuing binding jurisprudence. Thus, the Constitutional Court has identified the presence of a private party with standing to sue and be sued and a public party with standing to sue, and has focused its analysis on the sphere of competence of each of them, to determine how the rights to decent housing, to priority attention, to access to quality public services and to the protection of the plaintiff's property were violated. Therefore, in the development of this case study, the most relevant legal concepts used by the court in the resolution of this case were examined, in order to understand the way in which fundamental rights influence the ecuadorian notarial service and the relationships between individuals.
