Review of the laws in Ecuador regarding shared custody of children and adolescents, an analysis of the literature

The work that is presented has its object of study in the shared custody in the legislations of Ecuador, as a theme that over the years has gained relevance. This is due to the problems caused by the existing system of maternal preference, which discriminated against and deprived the father figure of rights in having custody of the children. In the same way, its importance is focused on the protection of infants, as the most vulnerable subject in the processes of marital and family breakdown, constituting the legislation of shared custody as a satisfactory solution in the determination of rights for the child, the father and the mother in post-marital conflicts. The objective is to carry out an analysis of the literature on the existing legislation in Ecuador regarding shared custody of children and adolescents. In its development, a qualitative methodology was used, through documentary analysis, where surveys were applied to functional and fractional families to evaluate this problem, the effects it causes and the existing novelties in the legislation in Ecuador. The survey was applied to a sample of n=84 people. In establishing the results, reference was made to comparative law, for the analysis of legislation in countries such as Chile, France and Spain, considering that shared custody where both parents have the same rights and conditions in the care of their children is the general rule. which should be applied. Additionally, in the analysis of the surveys, various problems associated with single-parent and exclusive custody were verified, giving relevance to legislation on joint custody. It is concluded that it is necessary to make a reform to the existing regulations in Ecuador, where the form of application of the tenure regime by both parents of minor children is regulated.
