Legal guidelines for the incorporation of a microenterprise producing spiced wine in Portoviejo: strategic, operational, and financial analysis

Abstract

This article broadly presents the essential legal guidelines for the incorporation of a microenterprise dedicated to the production of spiced wine in the city of Portoviejo. It combines strategic analysis, the design of an operational plan, and a five-year financial projection. In the strategic phase, tools such as the PESTEL analysis are used, which examines political, economic, social, technological, ecological, and legal factors; the SWOT analysis, which identifies strengths, opportunities, weaknesses, and threats; and the Business Model Canvas, which provides a structured view of the business model. The main legal requirements that every microenterprise must comply with are reviewed: corporate incorporation through a public deed registered in the Mercantile Registry; obtaining the Unique Taxpayer Registry (RUC) from the Internal Revenue Service (SRI); the municipal license and land use permit issued by the Decentralized Autonomous Government (GAD); operating permits granted by the Fire Department; employer registration and worker affiliation with the Ecuadorian Institute of Social Security (IESS); and health registration with the National Agency for Health Regulation, Control, and Surveillance (ARCSA) to ensure product safety. It is established that formal compliance with these requirements not only guarantees the legality of the company but also enables access to financing, entry into formal markets, and the generation of consumer trust.
