Protección de los derechos de la niñez en el Ecuador: un análisis de las garantías y medidas cautelares bajo el criterio de la corte constitucional

Abstract

This article analyzed the protection of children's rights in Ecuador based on the study of constitutional guarantees and precautionary measures recognized by the Constitutional Court. The objective was to determine how jurisprudence contributed to the effective protection of children and adolescents in situations of vulnerability. A qualitative case study approach was applied, supported by the analytical-synthetic and hermeneutical methods, which allowed the examination of eight rulings issued by the Constitutional Court between 2020 and 2023. The results showed that the Court established criteria that prioritized the best interests of the child, strengthening the use of guarantees such as the protection action, habeas corpus, and precautionary measures to prevent irreparable harm. In this way, a trend toward incorporating international human rights standards into the reasoning of its decisions was identified, reinforcing the coherence of the protection system. In conclusion, constitutional jurisprudence currently constitutes a fundamental pillar for guaranteeing children's rights in Ecuador, although challenges remain in the practical application of these measures, which demand stronger institutional commitment to close the gap between legal recognition and effective protection.
